Milpitas water heater permits: replacement and heat-pump installation

We are an independent referral service, not a plumbing contractor. Requests go to Bay Water Plumbing & Water Systems. We may receive a referral fee. This is general planning information, not a diagnosis or an installation instruction.

The City of Milpitas lists different permit pathways for replacing a water heater and for certain heat-pump conversions. The important first step is matching the actual work to the city’s stated scope—not simply choosing the first water-heater option in the portal.[6]

This is a homeowner planning guide based on the city page reviewed October 27, 2026. It is not a permit application, approval, or installation instruction. Confirm the current pathway with your contractor and the city before work begins.

Replacing the same type in the same location

The city’s Water Heater Replacement at Existing Location pathway allows replacement of an existing gas or electric water heater with the same type in the same location, using the existing gas piping or existing electrical circuit outlet connection respectively. The city instructs applicants to select ONL WATERHEATER as the permit type.[6]

Before using this option, ask the installer:

The limited online heat-pump pathway

The city’s New Heat Pump Water Heater online pathway is more specific than a general permission for any heat-pump installation. Its published scope is a new heat-pump water heater replacing an existing gas water heater in the same location, with a new electrical circuit but without an electrical panel upgrade.[6]

The city adds the condition that no electric vehicle charger and no electric cooktop/range was installed in the existing home. For a project meeting this stated scope, the listed permit type is ONL HP WH.[6]

Do not treat that pathway as applying automatically to a relocation, a panel upgrade, or a home with those existing electrical loads. Ask the city or your contractor to confirm eligibility rather than guessing from the equipment name.

Work outside those listed scopes

For water-heater work not covered by the two listed pathways, the city instructs applicants to send a completed, signed Building Permit Application to BuildingPermitCenter@milpitas.gov for review. The official page links the application, an Electrical-Mechanical-Plumbing Permit Application Worksheet, and an Owner-Builder Acknowledgment.[6]

For a new heat-pump water heater outside the online ONL HP WH scope, the city provides an Electric Panel Size Check form. Its instructions say to include the completed form with the permit application and identify the existing panel size if no upgrade is needed, or the new panel size if an upgrade is required. The page says to download the file to enable the checker.[6]

Have the qualified installer address the electrical assessment. This guide does not calculate your panel capacity or establish that an upgrade is or is not necessary.

Fees, installation requirements, and inspections

The official water-heater page links the city’s fee schedule, residential water-heater installation requirements, and Inspection Services. Use those current city resources and ask which apply to your project. We do not quote a fixed permit fee, guarantee an approval time, or reproduce technical installation requirements here.[6]
